News + EventsKim Davis Obtains "Not-Guilty" Verdict in the Defense of a Left-Turning New DriverPartner Kim Davis recently completed a 3 day jury trial in DuPage County defending a 16-year-old new driver in a left-turn automobile accident case. The young client executed a left turn directly in front of the 62 year old Plaintiff, resulting in a heavy impact. Plaintiff's post-accident MRI revealed significant damage to 3 tendons in his rotator cuff, necessitating immediate surgery and physical rehabilitation. Medical bills approached $35,000. Ms. Davis contended that plaintiff's 2 year history of pre-accident shoulder problems led to the findings on the post-accident MRI, and that the car accident neither caused nor aggravated this pre-existing condition. Plaintiff asked the jury for $139,554 (medical bills, pain and suffering and loss of normal life). In possibly the shortest jury deliberation in firm history, the jury decided to take a straw poll prior to substantively discussing the facts and evidence presented during the trial. The result was a 12-0 vote for a not-guilty verdict in favor of the defense, ending deliberations. |
