James F. McCluskey is a partner in the firm and concentrates his practice in the trial of professional and commercial liability cases. Mr. McCluskey practices before all state and federal courts in Illinois. He is also admitted to the Eastern District of Wisconsin.
Education and Background Mr. McCluskey received a Bachelor of Science degree in Accounting from Elmhurst College in 1976. He received his Juris Doctor degree from Northern Illinois University in 1979 and a Master of Laws from The John Marshall Law School in 1988. He has been licensed to practice law since 1979. Mr. McCluskey is a 1981 graduate of the Loyola University Trial Advocacy program. He has written various articles for the DuPage County Bar and Kane County Bar Journals in the areas of tort and civil litigation and professional responsibility. He has authored a chapter on Arbitration and Mediation in the Insurance Industry for the Illinois Institute of Continuing Legal Education. He has given numerous presentations on various aspects of civil litigation for the DuPage County, Kane County and Illinois State Bar Associations, and for various insurance clients. He is also a licensed Real Estate Broker.
Work Experience After receiving his law degree and license in 1979, Mr. McCluskey worked as in-house counsel for CNA Insurance. From 1981 through 1986, he worked at Hubbard, Hubbard, O'Brien & Hall, a Chicago insurance defense firm. From 1986 through 1988, he was employed as an associate for Wylie Wheaton & Associates, a general practice firm in Wheaton , Illinois . He joined Clausen Miller, P.C., a 150 attorney firm based in Chicago and Wheaton , Illinois , in 1988, where he continued to practice insurance defense litigation and civil litigation. He joined Momkus McCluskey Monroe Marsh & Spyratos, LLC as a partner in 1991. He has tried over 55 civil jury trials to verdict in Cook and the collar counties of Chicago . He has tried cases in Federal Court of the Central and Northern Districts of Illinois . His trials have involved Wrongful Death, Structural Work Act, premises liability, insurance coverage, automobile and complex commercial cases.
Jim was the Assistant Treasurer of the DuPage County Bar Association and Chair of the Civil Practice Committee. Currently he is the General Counsel for the DuPage County County Bar Association. He was Chair of the Illinois State Bar Association Assembly Agenda & Program Committee and a member of the ISBA Civil Practice & Procedure Council (2004-2005 and 2005-2006). Currently he serves on the Illinois State Bar Association Tort Law and Judicial Evaluation Committees. He was the President of the DuPage County Bar Association (2001-2002) and also the DuPage County Delegate to the American Bar Association in 2002. He is a member of the Federal Trial Bar and is admitted to the 7th Circuit Court of Appeals.
Jim was honored as an Illinois "Super Lawyer" in 2007 for his work in Commercial Litigation and in 2008 for his work in Business Litigation, Real Estate Litigation and Insurance Law.
In 2008, Jim also received the prestigious "Lawyer of the Year" award, given by the DuPage County Bar Association for Distinguished Leadership and Meritorious Service Rendered.
Personal Mr. McCluskey resides in Batavia , Illinois with his wife, Jeanne, and two children. His hobbies include Ironman Triathlon training, marathon running, biking, master swimming, golf, and attending sporting events.
